These companies are pouring billions into new facilities, from EV battery plants to semiconductor foundries, creating tens of thousands of American jobs.
However, the current immigration framework, particularly for intra-company transfers, just isn't keeping pace with this unprecedented influx. Asian firms, especially those from South Korea and Japan, typically rely on transferring experienced engineers, technicians, and management staff from their home countries to supervise the installation of complex machinery, transfer proprietary knowledge, and train local workforces during the crucial ramp-up phase. These aren't just any employees; they're the institutional memory and technical backbone of these multi-billion-dollar projects.
The problem primarily centers around the availability and processing times for L-1 visas, designed for intra-company transferees. While the H-1B visa for specialty occupations is well-known for its annual lottery and strict caps, the L-1 category, particularly L-1B for specialized knowledge, faces its own set of hurdles, including increased scrutiny and often lengthy, unpredictable processing.
